On October 5, 2011, Judge Jones of the United States District Court for the Southern District of New York granted class certification to the class in Janes v. Triborough Bridge & Tunnel Authority, No. 06cv1427. In this class action, Plaintiffs challenge, as violative of several articles of the United States and New York constitutions, the TBTA discriminatory pricing policy on its bridges that affords discounts to residents of certain zip codes but not to other bridge users. On October 4, 2011, Judge Berman of the United States District Court for the Southern District of New York appointed KOL lead counsel in Youngblood v. Family Dollar Stores, Inc. , No. 09cv3176. This is a Rule 23 class action brought under the New York Labor Law asserting that Family Dollar misclassified its New York Store Managers as exempt employees and wrongfully failed to pay them overtime. United States District Court Judge Jack Zouhary of the Northern District for Ohio has conditionally certified as a collective action under the Fair Labor Standards Act, a class of approximately 44,000 employees classified by HCR Manorcare, Inc. as non-exempt employees in states outside of California and Wisconsin.
